The Watch & Win Awards Contest
Official Contest Rules (the Contest Rules)
NO PURCHASE NECESSARY. The Contest will be conducted in Canada only and shall be construed according to applicable Canadian law.

Definitions

In these Program Rules and Regulations,

(a) “Program Sponsors” means Scotiabank and Studentawards Inc.
  • 1. Who Can Enter

    The “Watch & Win Awards” Contest (the “Contest”) is open to legal residents of Canada who are 17 years or older at time of entry, and who have proof of enrolment in a Canadian high school or post-secondary school in 2010. Void in whole or in part where prohibited by law. Individuals associated with the Contest, including employees of Studentawards Inc. (the “Sponsor”), The Bank of Nova Scotia (the “Contest Partner”), their subsidiaries and affiliated companies, and each of their respective directors, officers, employees, agents, representatives, promotional and marketing agencies, and any member of the immediate families of any of the foregoing and other individuals with whom any of the foregoing are domiciled, are not eligible to participate in the Contest.

  • 2. Contest Period

    The Scotiabank “Watch & Win Awards” Contest commences on Thursday, April 1, 2010 at 11:59 a.m. (ET) and ends on December 30, 2010 at 11:59 a.m (ET) (the “Contest Period”).

  • 3. How to Enter

    NO PURCHASE NECESSARY. Entrants must watch the instructional video in full and click on the “Enter the Contest” button and complete the Contest entry form. Contest entrants are required to provide the following information:

    1. First & Last Name
    2. Email
    3. Phone
    4. City & Province

    Once the Contest entry form is completed and submitted online, entrants will be automatically entered into the Contest. Entrants can enter the Contest only once each month of the Contest Period. All entries become the property of the Program Sponsors, each of whom assumes no responsibility whatsoever for late, lost, destroyed, illegible, incomplete, misidentified or misdirected entries or for any technical, hardware or software malfunctions of any kind, lost or unavailable network, failed or incorrect communications caused by the sender, online communication problems, or for any losses, liabilities or damages whatsoever (including, without limitation, incidental, consequential, special or indirect damages) arising out of or in any way connected with the equipment or programming associated with or utilized in the Contest. By entering this Contest, entrants agree to abide by the Contest Rules and the decisions of the Program Sponsors, which are final.

  • 4. Prizes

    There will be Twenty (20) individual prizes in total and will be given away to 20 winners; each prize is worth $500.00 CDN.

    • April: 2 (two) cash prizes of $500
    • May: 2 (two) cash prizes of $500
    • June: 2 (two) cash prizes of $500
    • July: 2 (two) cash prizes of $500
    • August: 2 (two) cash prizes of $500
    • September: 2 (two) cash prizes of $500
    • October: 2 (two) cash prizes of $500
    • November: 3 (three) cash prizes of $500
    • December: 3 (three) cash prizes of $500


  • 5. Prize Conditions

    The following other conditions apply to the Prizes:

    (a) Prizes must be accepted as awarded.

    (b) Where applicable, each Contest winner is responsible for all taxes, surcharges and fees associated with receipt or use of a Prize. Any charges and/or expenses not specifically mentioned as included in the Prize are the responsibility of the winner.

    (c) Entrants are restricted to winning one prize per Contest month.

    (d) Program Sponsors do not assume any liability for lost or misdirected prizes.

    (e) Other restrictions may apply.

  • 6. Contest Draw Date

    On or about May 4, 2010 – June 3, 2010 – July 5, 2010 – August 3, 2010 – September 20, 2010 – October 5, 2010 – November 4, 2010 – December 3, 2010 – January 10, 2011 at 3:00 p.m. (ET) in Toronto, Ontario, contest entries will be drawn at random by Studentawards Inc. from among all eligible entries. The odds of winning depend on the total number of eligible entries received.

  • 7. How to Claim Your Prize

    Program Sponsor will attempt to contact each selected entrant (or if the selected entrant is a minor, his or her legal guardian) within five (5) business days of the Contest draw by e-mail or telephone at Sponsor’s sole discretion, from the information provided by the selected entrant in his or her Contest entry form.

    In order to be confirmed as a winner in the Contest, each selected entrant must have complied with and remain in compliance with these Contest Rules, and must first correctly answer (or if the selected entrant is a minor, his or her legal guardian must correctly answer) without assistance of any kind, a time-limited, mathematical, skill-testing question to be administered at a pre-arranged time by telephone.

    In addition to the foregoing the selected entrant must have reached the age of majority in their Province of residence on or before the Contest Draw Date in order to claim a Prize, otherwise the Prize will be awarded to the parent or legal guardian of the entrant, or an alternative winner will be chosen. The parent or legal guardian of the minor will be responsible for signing a Receipt, Release, Discharge, Publicity and Indemnity form on behalf of the minor. Program Sponsor reserves the right to verify the age of any selected Prize winner.

    Should a selected entrant not be reached within the 5 day period, for any reason, including, but not limited to, the fact that a selected entrant did not provide a functioning e-mail address or valid telephone number, or if that selected entrant is unable to answer the skill-testing question or does not meet all of the Contest conditions, the prize shall be automatically forfeited by that selected entrant. In such event, another draw shall then be conducted where one (1) entry will be drawn at random from among all remaining eligible entries received during the Contest Period. A Program Sponsor employee will attempt to contact the new selected entrant within five (5) business days of the time at which such entrant was selected, by email or telephone, and subject to the same conditions as set out in this clause and in these Contest Rules. This process will be repeated until sufficient entrants are declared Contest winners or until no Contest entries remain. No communication will be entered into except with the selected entrants.

    By entering the Contest, each Contest winner consents to the use of his or her name, city of residence, voice, photograph, statements and/or likeness, without additional compensation or permission, except where prohibited by law, in any publicity or advertising in any medium throughout the world in perpetuity carried by or on behalf of Sponsor, Contest Partners and/or their agencies and affiliates or agents.

    If a selected entrant or declared winner is not in compliance with these Contest Rules, or is found ineligible, the Prize will be forfeited and an alternate entry selected.

  • 8. General Rules

    (a) All entries become the property of the Program Sponsor and none shall be returned.

    (b) Any entry that is incomplete, illegible, damaged or irregular, or that contains false information is invalid.

    (c) Program Sponsor reserves the right, in its sole discretion, to terminate, close, suspend, reinstate or amend the Contest, in whole or in part, at any time without prior notice for any reason whatsoever, and if required in the case of Quebec, the consent of the Régie des alcools, des courses et des jeux.

    (d) By entering the Contest, each entrant agrees to abide by these Contest Rules, which are subject to change without notice to Contest entrants individually and which changes shall be posted at this page of the Site.

    (e) By entering the Contest, each entrant automatically releasees each of the Releasees (as defined below) and any other person or entity associated in any way with the Contest from any and all liability arising in any manner out of the Contest, including without limitation, the selection of any prize winners, the administration of the Contest, and the acceptance or the use of any or all of the prizes as awarded.

    (f) All decisions by Program Sponsor with respect to all aspects of the Contest shall be final and binding. All entrants agree to abide by all of the instructions and decisions of Program Sponsor. In the event of any dispute regarding the interpretation of these Contest Rules or any decision rendered by Program Sponsor, the decision or interpretation of Program Sponsor shall prevail.

    (g) Any attempt to tamper with the entry process, to interfere with the Contest or these Contest Rules, to deliberately damage any website or to undermine the administration, security or legitimate operation of the Contest, may be a violation of criminal and civil laws and each of the Sponsor and Contest Partner reserves the right to seek damages or other relief or both from all persons responsible for such acts to the fullest extent permitted by law, which may include banning or disqualifying entrants from this and future contests involving the Program Sponsors.

    (h) The Releasees (defined in paragraph (k)) are not responsible for any technical problems, malfunctions of any telephone lines, computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. The Releasees are not responsible for any liability for damage to any computer system resulting from participation in or accessing or downloading information in connection with this Contest.

    (i) Neither Program Sponsor assumes responsibility of any nature whatsoever in all cases where the inability to hold the Contest results from any event beyond the reasonable control of Sponsor or Contest Partner, including without limitation, any Act of God, any strike, lock-out or other labour conflict, war, act of terror, or should a virus, worm, bug or other cause beyond the reasonable control of Sponsor or Contest Partner corrupt the security, data integrity, or proper administration of the Contest.

    (j) Privacy: By entering this Contest, entrant consents to Program Sponsors using the personal information submitted with their entry both for the purpose of administering the Contest and for the purposes as described in the Studentawards Inc. Privacy Policy. In addition, by entering this Contest, entrant consents to Program Sponsors contacting them during the Contest Period to promote the Contest and Program Sponsor offers. If available, by specifically checking an additional Program Sponsor information check-box on the Entry Form, entrant consents to the Program Sponsors using the personal information submitted with such entry including, but not limited to, contacting the entrant in the future to provide electronic newsletters and mailings, and other promotions and product and/or service offerings of the Program Sponsors.

    (k) No Liability of Releasees: The Program Sponsors, their affiliated companies, associates, directors, officers, employees, agents, successors and assigns (collectively, the “Releasees”) are responsible for any negligence, claims, liability, injury up to and including death, property loss or other damage to entrant, winner and/or travelling companion arising from or in connection with the acceptance, redemption or use/misuse of a Prize or participation in this Contest. The Prize winner(s) assume all liability for any injury or damage caused, or claimed to be caused, by participation in this Contest or use or redemption of the prizes.

    (l) The Releasees shall not be responsible for entries not received or not considered eligible due to incomplete, inaccurate, unclear or indecipherable information, failed or interrupted network connections or other mechanical or technical problems, however caused, (including a busy phone signal). The Releasees shall have no liability for lost, stolen, delayed, damaged or misdirected Contest entries, or for any failure, interruption, delay, error or omission of the Site or the Program Sponsor websites (the "Websites") or features on the Websites during the Contest, for any problems related to the Websites or the Site, including mechanical or technical malfunction of, or damage to, any telephone network or lines, computer online systems, servers, access providers, computer equipment, software, for failure of any email or Contest entry to be received by Program Sponsors for any reason, for damage to a entrant's or any other person's computer, or for breaches of privacy for any reason beyond the control of the Releasees, including interference by third party computer "hackers".

    (m) This Contest is subject to all applicable federal, provincial and municipal laws and is void outside Canada or where prohibited by law. Any dispute arising hereunder shall be adjudicated in the applicable court in Toronto, Ontario. For residents of Quebec: any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling; and any litigation respecting the awarding of a prize may be submitted to the Régie des alcools, des courses et des jeux only for the purpose of helping the parties reach a settlement.

    (n) If any provision of these Contest Rules or the application thereof to any person or circumstance shall, to any extent, be invalid or unenforceable, the remainder of these Contest Rules, or the application of such provision to persons or circumstances other than those as to which it is held invalid or unenforceable, shall not be affected thereby and each provision of these Contest Rules shall be valid and enforced to the fullest extent permitted by law and be independent of every other provision of these Contest Rules.
